It's almost awe-inspiring to see the level of energy and coordination the Bush White House can bring to bear in a genuine crisis. Not hurricane Katrina, of course, but the political crisis they now find rising around them.
As we noted yesterday, the storyline and the outlines of the attack are now clear: pin the blame for the debacle on state and local authorities.
So, let's get all the facts out on the table now. And let's not be afraid to let them all fall where they may. There's no need to make saints of Gov. Blanco or Mayor Nagin. In such a storm of error as this, it would not surprise me if they made a number of them too. But the reason you have a federal government and particularly a FEMA in cases like this is that it is in the nature of local and state authorities to be at least partly overwhelmed in disasters of this magnitude. Read what Ed Kilgore wrote a couple days ago at TPMCafe ...
Anyone who's been involved in a disaster response episode will tell you the first few days are characterized by absolute chaos. Basic logistics are fouled up; communications systems are paralyzed; a thousand urgent needs must be triaged; a vast welter of well-meaning but tunnel-visioned federal, state and local agencies, plus private charitable organizations and volunteers, rush in; local elected officials are forced in front of cameras to inform and reassure the affected population. Somebody has to be in charge of the chaos, and that's FEMA's job.
This is just one of the many reasons why the White House's main excuse -- that the locals didn't tell us what to do -- is such a grim joke.
But let me, just for starters, focus in on one specific case. Administration officials gave a series of blind quotes for an article that appeared in today's Washington Post.
One passage reads as follows ...
Louisiana did not reach out to a multi-state mutual aid compact for assistance until Wednesday, three state and federal officials said. As of Saturday, Blanco still had not declared a state of emergency, the senior Bush official said.
I don't have the details yet on the first point about the multi-state mutual aid compact. The state authorities seem to be saying that there was little point in making the request since the nearby states were also hit by Katrina. Indeed, this article says that Blanco accepted an offer of National Guard troops from New Mexico on Sunday, but that the paperwork didn't arrive from Washington until Thursday.
But let's focus in on the second point. Had Blanco still not declared a state of emergency as late as yesterday?
On the state of Louisiana website you can find this letter Gov. Blanco sent to President Bush on August 28th, that was last Sunday, just on the eve of the hurricane's landfall. (Here's the PDF and here is a text transcription.) Basically the letter is a laundry list of requests for aid and assistance from the federal government, invoking various laws, and so forth.

Under the provisions of [the relevant federal law], I request that you declare an emergency for the State of Louisiana due to Hurricane Katrina for the time period beginning August 26, 2005, and continuing ... In response to the situation I have taken appropriate action under State law and directed the execution of the State Emergency Plan on August 26, 2005 in accordance with Section 501 (a) of the Stafford Act. A State of Emergency has been issued for the State in order to support the evacuations of the coastal areas in accordance with our State Evacuation Plan ... Pursuant to 44 CFR § 206.35, I have determined that this incident is of such severity and magnitude that effective response is beyond the capabilities of the State and affected local governments, and that supplementary Federal assistance is necessary to save lives, protect property, public health, and safety, or to lessen or avert the threat of a disaster ...
The referenced state declaration of emergency was apparently declared on August 26th, that is, the Friday before landfall.
There's also this Statement on Federal Emergency Assistance for Louisiana, which appears on the White House website dated August 27th, which begins: "The President today declared an emergency exists in the State of Louisiana and ordered Federal aid to supplement state and local response efforts in the parishes located in the path of Hurricane Katrina beginning on August 26, 2005, and continuing."

The President's action authorizes the Department of Homeland Security, Federal Emergency Management Agency (FEMA), to coordinate all disaster relief efforts which have the purpose of alleviating the hardship and suffering caused by the emergency on the local population, and to provide appropriate assistance for required emergency measures, authorized under Title V of the Stafford Act, to save lives, protect property and public health and safety, or to lessen or avert the threat of a catastrophe ... Specifically, FEMA is authorized to identify, mobilize, and provide at its discretion, equipment and resources necessary to alleviate the impacts of the emergency.
Now, it seems to me there are three points that make sense to raise with all this data.
The first is the importance of keeping an eye on the big picture and that is the fact that this whole conversation we're having now is not about substance, but procedural niceties, excuses which is it is beyond shameful for an American president to invoke in such a circumstance. We don't live in the 19th century. All you really needed was a subscription to basic cable to know almost all of the relevant details (at least relevant to know what sort of assistance was needed) about what was happening late last week. The president and his advisors want to duck responsibility by claiming, in so many words, that the Louisiana authorities didn't fill out the right forms. So what they're trying to pull is something like a DMV nightmare on steroids.
Second, as long as the White House wants to play this game, there are various invocations of federal statutes in this proclamations. And we'd need a lawyer with relevant experience to pick apart whether the right sections and powers were invoked.
Third -- and this is key -- even on its own terms, the White House's claims seem false on their face. The plain English of this documents shows that states of emergency had been declared on both the state and federal level before the hurricane hit and that at the state's request the president had given FEMA plenary powers to "identify, mobilize, and provide at its discretion, equipment and resources necessary to alleviate the impacts of the emergency."

First: it's always been a problem, not just with Bush:
Naturally, Bush's critics want to make this into a major issue in the run-up to the 2006 mid-term elections next fall. But the reality is more complex than the Bush Blamers will admit. They want you to believe that inadequate flood-control protections became a problem only after Bush took office. However, the New Orleans Times-Picayune has written numerous articles over the years describing the threat posed by inadequate funding for flood-control measures. Many of these articles, such as the one authored by Pam Louwagie on June 1, 1999 (see extended entry), appeared well before President Bush took office.
The Times-Picayune's articles make clear that throughout much of the 1990s, officials in Louisiana couldn't come up with state money needed to match federal funds. The resignation of Rep. Bob Livingston in December 1998 didn't help. (Livingston was chairman of the House Appropriations Committee; federal funding for flood control projects was one of his pet projects.) Nor did environmental laws, such as the Migratory Bird Act of 1918. (Construction on a hurricane protection levee in St. Charles Parish was halted for months because a great egret nesting area sat in the levee's path.)
Don't forget to blame environmental laws.
Next, bring up something unrelated and say there wasn't actually a problem:
One of Bush's critics cited a February 16, 2004, New Orleans CityBusiness article. That critic, however, chose not to excerpt these two sentences:The Corps' New Orleans district in 2003 spent about $409 million on construction contracts, dredging and maintenance for the state's waterways, real estate purchases, private sector design contracts and in-house expenditures, according to the Corps. That more than doubles the $200 million the district spent in 1991.
Presumably those sentences were omitted because they do not support the notion that the Army Corps of Engineeers in New Orleans was starved for funds.
I don't see any mention of hurricane protection or levy funding there. And while I can't find the original article for context, this is what was quoted:
The $750 million Lake Pontchartrain and Vicinity Hurricane Protection project is another major Corps project, which remains about 20% incomplete due to lack of funds, said Al Naomi, project manager. That project consists of building up levees and protection for pumping stations on the east bank of the Mississippi River in Orleans, St. Bernard, St. Charles and Jefferson parishes.
The Lake Pontchartrain project is slated to receive $3.9 million in the president's 2005 budget. Naomi said about $20 million is needed.
"The longer we wait without funding, the more we sink," he said. "I've got at least six levee construction contracts that need to be done to raise the levee protection back to where it should be (because of settling). Right now I owe my contractors about $5 million. And we're going to have to pay them interest."
Finally, claim there was no problem, since the levy was just upgraded:
And don't expect Bush's critics to mention that the main levee that was breached earlier this week had recently been upgraded. Per the New York Times:No one expected that weak spot to be on a canal that, if anything, had received more attention and shoring up than many other spots in the region. It did not have broad berms, but it did have strong concrete walls.
Shea Penland, director of the Pontchartrain Institute for Environmental Studies at the University of New Orleans, said that was particularly surprising because the break was "along a section that was just upgraded."
"It did not have an earthen levee," Dr. Penland said. "It had a vertical concrete wall several feel thick."
"I know because it is impossible for a tape to hold the compression levels of these treble boosted MFSL's like Something/Anything. The metal particulate on the tape would shatter and all you'd hear is distortion if even that." - VD

Please forgive us if we wait to see proof of your promise before believing you. But we have good reason for our skepticism.
Bienville built New Orleans where he built it for one main reason: It’s accessible. The city between the Mississippi River and Lake Pontchartrain was easy to reach in 1718.
How much easier it is to access in 2005 now that there are interstates and bridges, airports and helipads, cruise ships, barges, buses and diesel-powered trucks.
Despite the city’s multiple points of entry, our nation’s bureaucrats spent days after last week’s hurricane wringing their hands, lamenting the fact that they could neither rescue the city’s stranded victims nor bring them food, water and medical supplies.
Meanwhile there were journalists, including some who work for The Times-Picayune, going in and out of the city via the Crescent City Connection. On Thursday morning, that crew saw a caravan of 13 Wal-Mart tractor trailers headed into town to bring food, water and supplies to a dying city.
Television reporters were doing live reports from downtown New Orleans streets. Harry Connick Jr. brought in some aid Thursday, and his efforts were the focus of a "Today" show story Friday morning.
Yet, the people trained to protect our nation, the people whose job it is to quickly bring in aid were absent. Those who should have been deploying troops were singing a sad song about how our city was impossible to reach.
We’re angry, Mr. President, and we’ll be angry long after our beloved city and surrounding parishes have been pumped dry. Our people deserved rescuing. Many who could have been were not. That’s to the government’s shame.
Mayor Ray Nagin did the right thing Sunday when he allowed those with no other alternative to seek shelter from the storm inside the Louisiana Superdome. We still don’t know what the death toll is, but one thing is certain: Had the Superdome not been opened, the city’s death toll would have been higher. The toll may even have been exponentially higher.
It was clear to us by late morning Monday that many people inside the Superdome would not be returning home. It should have been clear to our government, Mr. President. So why weren’t they evacuated out of the city immediately? We learned seven years ago, when Hurricane Georges threatened, that the Dome isn’t suitable as a long-term shelter. So what did state and national officials think would happen to tens of thousands of people trapped inside with no air conditioning, overflowing toilets and dwindling amounts of food, water and other essentials?
State Rep. Karen Carter was right Friday when she said the city didn’t have but two urgent needs: "Buses! And gas!" Every official at the Federal Emergency Management Agency should be fired, Director Michael Brown especially.
In a nationally televised interview Thursday night, he said his agency hadn’t known until that day that thousands of storm victims were stranded at the Ernest N. Morial Convention Center. He gave another nationally televised interview the next morning and said, "We’ve provided food to the people at the Convention Center so that they’ve gotten at least one, if not two meals, every single day."
Lies don’t get more bald-faced than that, Mr. President.
Yet, when you met with Mr. Brown Friday morning, you told him, "You’re doing a heck of a job."
That’s unbelievable.
There were thousands of people at the Convention Center because the riverfront is high ground. The fact that so many people had reached there on foot is proof that rescue vehicles could have gotten there, too.
We, who are from New Orleans, are no less American than those who live on the Great Plains or along the Atlantic Seaboard. We’re no less important than those from the Pacific Northwest or Appalachia. Our people deserved to be rescued.
No expense should have been spared. No excuses should have been voiced. Especially not one as preposterous as the claim that New Orleans couldn’t be reached.

You know, I don't think anybody anticipated this disaster. We just didn't know it was coming. FEMA was caught off guard. It's Louisiana's fault. It's the mayor's fault. It's the fault of those lazy blacks who couldn't hop in their Escalades and get out of town. Certainly FEMA couldn't have foreseen this. How could you possibly expect them to plan for something so unthinkable?

It was a broiling August afternoon in New Orleans, Louisiana, the Big Easy, the City That Care Forgot. Those who ventured outside moved as if they were swimming in tupelo honey. Those inside paid silent homage to the man who invented air-conditioning as they watched TV "storm teams" warn of a hurricane in the Gulf of Mexico. Nothing surprising there: Hurricanes in August are as much a part of life in this town as hangovers on Ash Wednesday.
But the next day the storm gathered steam and drew a bead on the city. As the whirling maelstrom approached the coast, more than a million people evacuated to higher ground. Some 200,000 remained, however—the car-less, the homeless, the aged and infirm, and those die-hard New Orleanians who look for any excuse to throw a party.
The storm hit Breton Sound with the fury of a nuclear warhead, pushing a deadly storm surge into Lake Pontchartrain. The water crept to the top of the massive berm that holds back the lake and then spilled over. Nearly 80 percent of New Orleans lies below sea level—more than eight feet below in places—so the water poured in. A liquid brown wall washed over the brick ranch homes of Gentilly, over the clapboard houses of the Ninth Ward, over the white-columned porches of the Garden District, until it raced through the bars and strip joints on Bourbon Street like the pale rider of the Apocalypse. As it reached 25 feet (eight meters) over parts of the city, people climbed onto roofs to escape it.
Thousands drowned in the murky brew that was soon contaminated by sewage and industrial waste. Thousands more who survived the flood later perished from dehydration and disease as they waited to be rescued. It took two months to pump the city dry, and by then the Big Easy was buried under a blanket of putrid sediment, a million people were homeless, and 50,000 were dead. It was the worst natural disaster in the history of the United States.
When did this calamity happen? It hasn't—yet. But the doomsday scenario is not far-fetched. The Federal Emergency Management Agency lists a hurricane strike on New Orleans as one of the most dire threats to the nation, up there with a large earthquake in California or a terrorist attack on New York City. Even the Red Cross no longer opens hurricane shelters in the city, claiming the risk to its workers is too great.

Hey, he's on the ball! Unfortunately, they were talking about the wrong task:
I spoke to Mike Chertoff today -- he's the head of the Department of Homeland Security. I knew people would want me to discuss this issue, so we got us an airplane on -- a telephone on Air Force One, so I called him. I said, are you working with the governor? He said, you bet we are. That's the most effective way to do things, is to work with the state and local authorities. There are more resources that will be available, we'll have more folks on the border; there will be more detention space to make sure that those who are stopped trying to illegally enter our country are able to be detained.

Leaders Lacking Disaster Experience

Five of eight top Federal Emergency Management Agency officials came to their posts with virtually no experience in handling disasters and now lead an agency whose ranks of seasoned crisis managers have thinned dramatically since the Sept. 11, 2001, attacks.
FEMA's top three leaders -- Director Michael D. Brown, Chief of Staff Patrick J. Rhode and Deputy Chief of Staff Brooks D. Altshuler -- arrived with ties to President Bush's 2000 campaign or to the White House advance operation, according to the agency. Two other senior operational jobs are filled by a former Republican lieutenant governor of Nebraska anda U.S. Chamber of Commerce official who was once a political operative.
Meanwhile, veterans such as U.S. hurricane specialist Eric Tolbert and World Trade Center disaster managers Laurence W. Zensinger and Bruce P. Baughman -- who led FEMA's offices of response, recovery and preparedness, respectively -- have left since 2003, taking jobs as consultants or state emergency managers, according to current and former officials.
Because of the turnover, three of the five FEMA chiefs for natural-disaster-related operations and nine of 10 regional directors are working in an acting capacity, agency officials said.
Patronage appointments to the crisis-response agency are nothing new to Washington administrations. But inexperience in FEMA's top ranks is emerging as a key concern of local, state and federal leaders as investigators begin to sift through what the government has admitted was a bungled response to Hurricane Katrina.
"FEMA requires strong leadership and experience because state and local governments rely on them," said Trina Sheets, executive director of the National Emergency Management Association. "When you don't have trained, qualified people in those positions, the program suffers as a whole."
Last week's greatest foe was, of course, a storm of such magnitude that it "overwhelmed" all levels of government, according to Sen. Susan Collins (news, bio, voting record) (R-Maine). And several top FEMA officials are well-regarded by state and private counterparts in disaster preparedness and response.
They include Edward G. Buikema, acting director of response since February, and Kenneth O. Burris, acting chief of operations, a career firefighter and former Marietta, Ga., fire chief.
But scorching criticism has been aimed at FEMA, and it starts at the top with Brown, who has admitted to errors in responding to Hurricane Katrina and the flooding in New Orleans. The Oklahoma native, 50, was hired to the agency after a rocky tenure as commissioner of a horse sporting group by former FEMA director Joe M. Allbaugh, the 2000 Bush campaign manager and a college friend of Brown's.

Department of Homeland Security spokesman Russ Knocke said Brown has managed more than 160 natural disasters as FEMA general counsel and deputy director since 2001, "hands-on experience [that] cannot be understated. Other leadership at FEMA brings particular skill sets -- policy management leadership, for example."
The agency has a deep bench of career professionals, said FEMA spokeswoman Nicol Andrews, including two dozen senior field coordinators and Gil Jamieson, director of the National Incident Management System. "Simply because folks who have left the agency have a disagreement with how it's being run doesn't necessarily indicate that there is a lack of experience leading it," she said.
Andrews said the "acting" designation for regional officials is a designation that signifies that they are FEMA civil servants -- not political appointees.
Touring the wrecked Gulf Coast with Secretary of Homeland Security Michael Chertoff yesterday, Vice President Cheney also defended FEMA leaders, saying, "We're always trying to strike the right balance" between political appointees and "career professionals that fill the jobs underneath them."
But experts inside and out of government said a "brain drain" of experienced disaster hands throughout the agency, hastened in part by the appointment of leaders without backgrounds in emergency management, has weakened the agency's ability to respond to natural disasters. Some security experts and congressional critics say the exodus was fueled by a bureaucratic reshuffling in Washington in 2003, when FEMA was stripped of its independent Cabinet-level status and folded into the Department of Homeland Security.
Emergency preparedness has atrophied as a result, some analysts said, extending from Washington to localities.
FEMA "has gone downhill within the department, drained of resources and leadership," said I.M. "Mac" Destler, a professor at the University of Maryland School of Public Policy. "The crippling of FEMA was one important reason why it failed."
Richard A. Andrews, former emergency services director for the state of California and a member of the president's Homeland Security Advisory Council, said state and local failures were critical in the Katrina response, but competence, funding and political will in Washington were also lacking.
"I do not think fundamentally this is an organizational issue," Andrews said. "You need people in there who have both experience and the confidence of the president, who are able to fight and articulate what FEMA's mission and role is, and who understand how emergency management works."
The agency's troubles are no secret. The Partnership for Public Service, a nonprofit group that promotes careers in federal government, ranked FEMA last of 28 agencies studied in 2003.
In its list of best places to work in the government, a 2004 survey by the American Federation of Government Employees found that of 84 career FEMA professionals who responded, only 10 people ranked agency leaders excellent or good.
An additional 28 said the leadership was fair and 33 called it poor.
More than 50 said they would move to another agency if they could remain at the same pay grade, and 67 ranked the agency as poorer since its merger into the Department of Homeland Security.
Leaders Lacking Disaster Experience

Five of eight top Federal Emergency Management Agency officials came to their posts with virtually no experience in handling disasters and now lead an agency whose ranks of seasoned crisis managers have thinned dramatically since the Sept. 11, 2001, attacks.
FEMA's top three leaders -- Director Michael D. Brown, Chief of Staff Patrick J. Rhode and Deputy Chief of Staff Brooks D. Altshuler -- arrived with ties to President Bush's 2000 campaign or to the White House advance operation, according to the agency. Two other senior operational jobs are filled by a former Republican lieutenant governor of Nebraska anda U.S. Chamber of Commerce official who was once a political operative.
Meanwhile, veterans such as U.S. hurricane specialist Eric Tolbert and World Trade Center disaster managers Laurence W. Zensinger and Bruce P. Baughman -- who led FEMA's offices of response, recovery and preparedness, respectively -- have left since 2003, taking jobs as consultants or state emergency managers, according to current and former officials.
Because of the turnover, three of the five FEMA chiefs for natural-disaster-related operations and nine of 10 regional directors are working in an acting capacity, agency officials said.
Patronage appointments to the crisis-response agency are nothing new to Washington administrations. But inexperience in FEMA's top ranks is emerging as a key concern of local, state and federal leaders as investigators begin to sift through what the government has admitted was a bungled response to Hurricane Katrina.
"FEMA requires strong leadership and experience because state and local governments rely on them," said Trina Sheets, executive director of the National Emergency Management Association. "When you don't have trained, qualified people in those positions, the program suffers as a whole."
Last week's greatest foe was, of course, a storm of such magnitude that it "overwhelmed" all levels of government, according to Sen. Susan Collins (news, bio, voting record) (R-Maine). And several top FEMA officials are well-regarded by state and private counterparts in disaster preparedness and response.
They include Edward G. Buikema, acting director of response since February, and Kenneth O. Burris, acting chief of operations, a career firefighter and former Marietta, Ga., fire chief.
But scorching criticism has been aimed at FEMA, and it starts at the top with Brown, who has admitted to errors in responding to Hurricane Katrina and the flooding in New Orleans.
